Terms of Use

These Terms of Use ("Terms") govern your access to and use of the ForecastPing mobile application (the "App") provided by Witzy Goods ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements.

2. License and Use

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a device that you own or control, strictly in accordance with these Terms and any applicable app store terms. You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works based on the App or any part of it.

3. Account and Data

The App stores your preferences (such as location, temperature unit, and reminder rules) locally on your device. You are responsible for maintaining the security of your device. We are not responsible for any loss of data resulting from device loss, damage, or unauthorized access.

4. Subscriptions and In-App Purchases

The App offers an optional paid subscription, ForecastPing Pro, which unlocks additional features. By purchasing a subscription, you agree to the following:

  • Payment: Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Renewal Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
  • Free Trials: If offered, any unused portion of a free trial period will be forfeited when you purchase a subscription.
  • Managing Subscriptions: You can manage or cancel your subscription at any time through your Apple App Store or Google Play Store account settings.
  • Price Changes: Subscription prices may change from time to time. We will notify you of any price changes in advance, and you will have the opportunity to cancel before the new price takes effect.

All purchases are processed by Apple or Google, and are subject to the respective app store's terms and conditions. We do not collect or store your payment information.

5. Weather Data and Accuracy

The App provides weather forecasts and clothing/gear reminders based on data obtained from third-party weather services (Open-Meteo). While we strive to present accurate and timely information, we do not guarantee the accuracy, completeness, or reliability of any weather data or recommendations provided by the App.

Weather conditions can change rapidly and unexpectedly. The clothing and gear reminders are suggestions only and should not be relied upon as the sole basis for decisions related to personal safety, travel, or outdoor activities. Always use your own judgment and consult official weather sources for critical decisions.

6. Notifications

The App may send you local push notifications with weather-based reminders if you enable this feature. You can disable notifications at any time through the App's settings or your device's notification settings. Notification delivery depends on your device and operating system and is not guaranteed.

7. Intellectual Property

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, and software — are the property of Witzy Goods or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks, logos, or branding without prior written permission.

8. Prohibited Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to the App's systems, servers, or networks
  • Interfere with or disrupt the operation of the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove, alter, or obscure any copyright or proprietary notices in the App
  • Use automated scripts, bots, or other tools to access or interact with the App

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WITZY GOODS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE APP EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Witzy Goods and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will continue to apply.

13. Third-Party Services

The App integrates with third-party services including Open-Meteo (weather data), RevenueCat (subscription management), and the Apple App Store and Google Play Store (payment processing). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved in the courts of competent jurisdiction.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Witzy Goods regarding your use of the App and supersede all prior agreements and understandings.
